Appeals court takes up ban on new roads in forests

A federal appeals court in Denver has heard oral arguments on a ban on building new roads in national forests.

The case filed by the state of Wyoming challenges the 2001 roadless rule, banning construction of new roads on at least 40 million acres of federal land nationwide.

Wyoming and the Colorado Mining Association argue the rule violates the 1964 Wilderness Act and the U.S. Department of Agriculture did not follow National Environmental Policy Act regulations by rushing the plan through at the end of the Clinton administration. The USDA and environmental groups say NEPA regulations were followed, including an environmental impact statement and sufficient public comment period.
